THROWING a bottle of Vodka at a complainant during an outburst outside her sister's house in Kilkeel has resulted in a defendant receiving a one month custodial sentence concurrent with time he is already serving in custody.

Appearing before Newry Magistrates via videolink from custody was Joseph Barry McCartan (38) with an address given as Maghaberry, Old Road Lisburn.

McCartan stands charged with a single count of common assault dating back to June 9th of this year.

It was at 9pm on this date the court would hear how police were tasked to a report of an ongoing incident in Kilkeel.

Upon arrival police would speak with the reporting party who alleged that when she was leaving her sister' s house she came upon the defendant McCartan who upon noticing her became aggressive.

The reporting party told officers that as she turned to walk back into her sister's house McCartan would proceed to throw a bottle of vodka towards her which smashed on the ground.

The court would hear how following this McCartan would continue to shout and swear outside the property whilst pulling at gates until police arrived wherein he calmed down.

Addressing the court defence counsel explained how McCartan did accept the single court of common assault but that he did not deliberately aim to throw the bottle of vodka at the complainant in the case.

Disposing of the case District Judge Natasha Fitzsimons would impose upon McCartan a one month sentence to run concurrently with the time he was already serving in custody.
