EXPERIENCING what his defence counsel described in court as a "late night" before taking the decision to drive whilst still under the influence the following evening has resulted in a Keady man receive a period of disqualification from driving.
Standing in the dock of Newry Magistrates to answer for a single count of driving with excess alcohol in his breathe was Bryan Kaiden Ruddy (19) of Clay Road Keady.
The court heard how at 6.10 in the evening of September 13 of this year police received a report of a single vehicle road traffic collision that took place within the vicinity of the Dundalk Road Cullyhana.
Upon arrival officers would observe a Seat Leon vehicle lying on its side with the defendant Ruddy present.
Police noted that the 19 year old Keady man was unsteady on his feet, with his speech being slurred and that he failed a preliminary breathe test providing a later evidential sample of 50miligrams of alcohol in his breathe.
Addressing the court a defence solicitor explained how Ruddy's crashing of the vehicle on the evening September 13 had in fact been as a result of him consuming alcohol the previous evening on September 12 stating that the defendant had a "very late night"
"He is 19 years of age and attends court with his mother. He is a farmer who works on the family farm. He is a hardworking young man.
This was 6pm the next evening and he wasn't consuming alcohol this day but had a very late night the night before, but had been about the house this day. He went to leave his friend home. Another vehicle came around the corner, he took evasive action and went into a ditch. He just misjudged his ability to get behind the wheel that day."In her disposal of the case District Judge Natasha Fitzsimons told Ruddy that she hoped to never see the 19 year old in the body of the court again.
